you can go on live. however as soon as you flash your xbox you are at risk of being banned. recently there has been a huge ban wave. so evry 1 reckons that mircrsoft can detct modified frimware. so if i was u i wouldnt flash my xbox yet and wait for ixtreme LT. if u do decide to flash it now dont go on live.

i would not risk it, microsoft just banned 1 million xboxes from live, i would wait till they figure out how microsoft can detect modded xboxes, no one knows how so, so no one can give you a clear answer on your questions, is it the burnt games or having a modded xbox itself that results in ban.
