Renters moved out, left stuff behind

August 9th, 2016

My mom was renting out her house to my bhers friend and his wife /kids, well they moved out on saturday, but left tons of stuff in their rooms, , well my moms wants to toss out all their stuff, (my mom thinks 3 days is enough to move out), well if my mom tosses their stuff would she get in trouble for it? Im asking since my older bher and him are still friends, how long legally is she required to hold onto their stuff? The reason she is rushing is because of course the mortgage, and she wants new renters.
they left things like animals….. bunnies, birds, turtles too.

we: Select all

if its in the contract that they move out by a that day. that stuff is now yours.
from what i understand, they told my mom a week ago they were moving out, (they got a apartment i heard), my mom did not evict them or anything, they did not give my mom a written note or anything, it was verbal and they have a month by month lease agreement i think.

I think the most resonable thing to do is to contact em
and ask , If they’ll refuse to take their stuff back then you can do whatever with em

Yeah mate. Contact them. But a few pointers from a practical side. If they pay rent month by month, and they say they are moving out mid month, they still have a few weeks left on their rent. So you wont be able to move their stuff out until they have used what they pay for, but by the sound of it this has already happened.
So next step is to contact them and give them fair warning. Say three working days, in writing if you are worried about it. This way, they have left stuff on your property, you have given them a written notice of what you are going to do and if they choose to ignore it, on their head be it. Move their stuff out and done. Not sure what country you are in mate, but you should have community lawers about. In NZ we have a tenancy tribunal, or tribunal of common sense, they sort this ~love~ out bloody quick as long as you have acted with good intentions and fairly.
In summary, as long as they have not paid to stay in the house for any longer, give them written warning, then move their stuff out.
Answer #7
just get in touch with them to sort out what is going on.
You cant just throw stuff out when animals/pets are concerned.

Where do you live . Laws differ a lot from state to state so one answer dosn’t fit in all cases
Here’s New Jersey law

Answer #9
In the UK where only offenders have any rights you would probably have to keep the stuff for 6 months then publish a notice in the local papers to give them another month in which to remove them even a car left on your drive requires the same here
Answer #10
Why are you bothering..since he’s still your bhers friend just ask him to call him & see if they want their stuff. & If he does, ask him to tell him to pick them up soon because your mom is tossing them out. no legal issues in between.
