Legal information for Modeling Pictures

August 18th, 2013

I do not own an Adult Website and do not plan on hosting nude pictures of women on the website, but if you were to upload pictures of models on your website, is their anything that someone would need to prove that they aren’t under the age of 18? I wouldn’t want to get into any legal trouble in regards to this issue, but I’m not sure on how the law works in the State of California, in the United States. Just want a heads up so I don’t break any laws.
Hope you guys can inform me on this matter better than I already know.
What is a good legal way for the model to provide legal documentation that she is over the age of 18?

This is a horrible grey area.
If you were to do it all yourself, you have model releases to think about AND you might be called to prove 18+ status – they need to prove to you that they are 18+ by whatever card is recognised where you are (Soc Sec number? 18+ card? Drivers License?).
The trouble comes when others upload to your site, you are technically responsible, yet how do you insist on proof or model releases or what ever?
It’s not a case of someone else proving they are under 18 – if there is legal challenge based on suspicion of age YOU have to provide the over 18 proof.
