Can I do this with a NDA Agreement?

August 2nd, 2013

So, I was talking with a programmer about developing an iPhone game and after signing the NDA document I exchanged the info for the game.
Now if I don’t want to work with that guy anymore and go on with another programmer, am I allowed to share that information (not the iPhone app code or the demo he made) but just my idea about the game? What about his additions to be made with the game?
I have exchanged a lot of information about the game with the first programmer and I was wondering if I could take that information we discussed and give it to programmer 2 to make a game.
I’m just confused if whether I’m allowed to release the information he sent back to me or any of the information we discussed. If the case is that it’s all the info, then does that means I can’t share that game info forever with another programmer and it only has to be with programmer 1?
I hope you followed that.

You should read through your Non-Disclosure Agreement again. It should state in there what can and cannot be disclosed by either party.
As far as I know, generally:
You are allowed to talk about things which you had thought about before your discussions with the programmer.
You are not allowed to talk about the ideas submitted by the other party (the programmer).
You are not allowed to talk about the ideas which developed as a result of your collaboration with the other member/s of the NDA.
You are allowed to talk about things which you have since dreamed up on your own, using the increased knowledge which you gained from your discussions with the programmer.
Be aware that NDAs are binding contracts and should not be taken lightly. Use integrity, otherwise future partners might think you cannot be trusted with confidential materials.
Disclaimer: I am not a lawyer – what do I know? This is just my opinion.

It also depends on the break-up.
If it was amicable, just as him.
If it was acrimonious, he’ll sue your arrse off for ANY breach.
